Acceptance of terms

By accessing or using BART, you agree to these Terms of Service. If you do not agree, do not use the platform.

Eligibility and accounts

You must be at least 18 years old and legally capable of entering into contracts. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.

BART's role as platform facilitator

BART is a facilitator that provides tools for users to discover each other and propose skill/service exchanges. BART is not an employer, agent, broker, or party to any trade agreement formed between users.

Trades and disputes

Users are solely responsible for deciding whether to enter a trade and for agreeing trade terms (scope, quality, deadlines, and deliverables). Any dispute, non-performance, or loss arising from a trade is between the participating users. BART may assist with reporting and moderation, but does not guarantee outcomes and has no liability as a contracting party.

User conduct

You must use BART lawfully and respectfully. You must not submit misleading listings, infringe rights, harass users, scrape the service, bypass security controls, or use the platform for fraud or illegal activity.

Listings and content

You retain ownership of content you upload. You grant BART a non-exclusive licence to host, display, and process that content to operate the platform. We may remove content that violates these terms or applicable law.

Fees and taxes

Unless stated otherwise, using the platform is free. You are responsible for your own taxes, reporting obligations, and legal compliance relating to services or goods exchanged through BART.

Intellectual property

BART and its platform materials are protected by intellectual property laws. You may not copy, reverse engineer, or commercially exploit BART branding, software, or content except as permitted by law.

Termination and suspension

We may suspend or terminate access for violations of these terms, security risks, legal requirements, or abuse. You may stop using the service at any time by closing your account.

Disclaimers

BART is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties including fitness for a particular purpose, non-infringement, and uninterrupted availability.

Limitation of liability

To the maximum extent permitted by law, BART will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from your use of the platform or from user-to-user trades.

Nothing in these terms excludes liability that cannot legally be excluded under UK law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Indemnity

You agree to indemnify and hold BART harmless from claims, losses, and costs (including reasonable legal fees) arising from your content, your breach of these terms, or your misuse of the platform.

Governing law and jurisdiction (UK)

These terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except where mandatory consumer protection law provides otherwise.

Changes to terms

We may update these terms from time to time. If changes are material, we will provide notice through the platform or by email. Continued use after changes take effect means you accept the revised terms.
